Simon is a leading Australian commercial litigation lawyer.

He advises in large scale commercial disputes, trustee litigation, commissions of enquiry, regulatory proceedings and shareholder class actions. He regularly acts for plaintiffs and defendants in disputes funded by third party litigation funders.

He is recognised as a leading expert in Australia in commercial litigation by Asia Pacific Legal 500, Doyles and Best Lawyers.

Tim is the Joint Head of the Melbourne Office and has extensive experience in intellectual property protection and commercialisation, and IT and telecommunications contracts, as well as commercial agreements, franchising, data protection, privacy and competition and consumer law.

Tim has experience in advising on all aspects of intellectual property protection, its commercialisation and enforcement and disputes. Tim assists clients with management of intellectual property portfolios in Australia and overseas including trade mark filings, prosecution and oppositions in Australia and overseas. A significant proportion of Tim’s work is in biotechnology and other high technology industries. This work includes drafting and negotiating complex licence and technology transfer agreements, clinical trial agreements, research and development agreements, collaboration agreements, manufacturing and quality agreements, and marketing agreements.

Tim has extensive experience advising IT and telecommunications service providers, as well as government and corporate clients procuring, software (including software development), software-as-a-service, IT services and telecommunications services.

Tim advises clients on data protection and privacy legislation including privacy policies and statements, data collection practices, data sharing arrangements and mandatory data breach notification. He assists public sector and private sector clients operating or entering into Australia as well as organisations operating overseas.

Tim has a Bachelor of Laws (Honours), Master of Laws and a Bachelor of Science, all from the University of Melbourne.

Andrea’s expertise extends to designing and conducting a broad range of financial services training for financial services providers, their senior executives and responsible managers, legal & compliance officers, consumer advocates and lawyers.

Andrea advises domestic and foreign institutions on acquiring financial services and credit licences and exemptions. She specialises in advising on structuring and establishing financial services and credit businesses including licence obligations, drafting plain English documents, procedures, systems audits and online web application processes. She also advises on regulatory compliance projects and audits, regulatory enforcement defences, and regulator investigations and disputes.

Andrea’s experience includes advising clients on financial products and channels, including FinTech solutions, peer to peer lending platforms, crowd funding, payment systems, crypto currency, reward programs, gift cards and financial services acquisitions, disposals and alliances.

Andrea also has in-depth knowledge of privacy laws and regularly advises clients on data and privacy security and breach remediation.

Andrea regularly conducts training programs and full day workshops for clients including Australian Credit Licence and Australian Financial Services Licence compulsory responsible managers training, privacy training, regulatory updates and “Back to Basics” credit law, privacy, anti-money laundering and other training workshops.

Andrea is widely published and her authorships include 6 editions of the leading consumer law text ‘Annotated National Credit Code’ the most recent edition published in November 2019 by LexisNexis, the ‘Australia’ chapters in the ‘Consumer Finance Law Review’ and the ‘Banking Regulation Review‘ (The Law Reviews, Law Business Research Ltd UK).
